Information Regarding Economic Stimulus Payments: Memo from Chapter 13 Trustees Dated 4/15/08
On February 13, 2008, President Bush signed the Economic Stimulus Act of 2008 (H.R. 5140). Under that legislation, most taxpayers will receive an economic stimulus rebate (technically known as an "advanced credit payment").
After carefully reviewing the legislation, the Chapter 13 Trustees for the Eastern District of Michigan have determined that, in their opinion, Debtors are not required to remit these rebates as part of the funding of their confirmed Chapter 13 Plans. These rebates will not be considered by the Chapter 13 Trustees to constitute either "tax refunds" or "disposable income."
